EvAAL ("EvAAL," "we," "our," or "us"). These Terms & Conditions ("Terms") govern your access to and use of the EvAAL website, platform, assessments, tools, reports, and related services (collectively, the "Services"). By accessing or using EvAAL, you agree to be bound by these Terms.

Description of Services

EvAAL is a digital assistive technology (AT) and augmentative and alternative communication (AAC) assessment support platform designed to provide interactive tools that assist educators, clinicians, school teams, and families in evaluating access needs and technology preferences. EvAAL does not replace professional judgment, team-based evaluation processes, or legally required assessments under IDEA, Section 504, ADA, or other applicable laws.

No Medical, Legal, or Diagnostic Advice

EvAAL is not a medical device, diagnostic tool, or treatment service. All outputs, recommendations, summaries, and reports generated by EvAAL are informational only and must be interpreted by qualified professionals. EvAAL makes no guarantees regarding outcomes, accuracy, or suitability for any specific individual.

Eligibility & Authorized Use

EvAAL is intended for use by educators, assistive technology professionals, speech-language pathologists, school personnel, and parents or legal guardians acting on behalf of a student. Users must be at least 18 years of age.

Intellectual Property Rights

All content and materials — including assessments, subtests, scoring logic, report structures, designs, and underlying software — are the exclusive intellectual property of EvAAL and protected by applicable law. Users are granted a limited, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose only.

Data Use & Privacy

EvAAL does not sell student data. Data is used solely to provide and improve the Services. De-identified and aggregated data may be used for analytics and research. Users are responsible for ensuring compliance with FERPA, IDEA, and all applicable privacy laws.

Payments, Subscriptions & Licensing

All fees are non-refundable unless otherwise stated. Licenses are non-transferable and limited to the scope purchased. EvAAL reserves the right to modify pricing or licensing models with notice.

Limitation of Liability

To the fullest extent permitted by law, EvAAL shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Use of EvAAL is at your own risk.

Governing Law

These Terms are governed by the laws of the State of California.
